The prosecution announced its decision Friday in San Diego County Superior Court in Vista, California, after the judge earlier this week declared a mistrial when the jury became deadlocked on the remaining charges, including two counts of rape.
The new trial is scheduled to begin Sept. 30.
Winslow, 35, remains jailed after defense’s request that he be released on $1 million bail and confined to his home was denied.
The jurors considered 12 criminal counts against Winslow: seven felonies and five misdemeanors involving the five women.
Taken by the Browns with the No. 6 overall pick in the 2004 NFL Draft, the younger Winslow suffered a broken right leg his rookie season then sustained a serious knee injury to the same leg in a motorcycle accident that offseason.
He played for the Browns, Buccaneers, Patriots and Jets in an NFL career that ended when he was suspended in 2013 while with the Jets for violating the league’s policy on performance enhancers.
